Planning Inspectorate Enforcement Appeal Hearing – Comments required by 25th August 2021
NWLDC served an enforcement notice on the owners and occupiers of the land at Whitegate Stables, Coleorton Lane on 21st July 2021.

The owners of the land have appealed this enforcement notice and an Enforcement Appeal Hearing will be held on the 25th August. Please see the attached letter for more details. Appeal Notification letter Whitegate Stables
The Parish Council intend to robustly respond to this appeal and NWLDC have appointed a specialist barrister to represent them at the Appeal. However, NWLDC have advised that all interested residents should be encouraged to comment to show strength of feeling and support.
The District Council’s reasons for issuing the Enforcement Notice were the following:
- The above breach of planning control occurred within the last 10 years.
- The Land is outside of the Limits to Development defined in the Local Plan 2021.Sites for Gypsies and Travellers will be supported when in accordance with (i) to(vi)of Policy S3 – Countryside and Policy H7 – Provision for Gypsies and Travellers and Travelling Showpeople.
- The Unauthorised Use, through caravans, hard surfacing, tarmac, and fencing, does not safeguard and enhance the appearance and character of the landscape -Policy S3(i).
- The development is not accessible by a range of sustainable transport as required by Policy S3 (vi).
- The Land is not located with reasonable access to a range of services, such as shops, schools, welfare facilities, or public transport contrary to Policy H7 (4)(a). The nearest settlements are approximately 1km away (Packington – identified as a sustainable village with limited services, and New Packington – A hamlet in the countryside), and accessed via a national speed limit road with no footways or street lighting making reliance on private car travel inevitable.
- The highway access is unsuitable as visibility splays of 215 metres cannot be achieved contrary to Policy H7(4)(c).
- There is no mains water supply, power, drainage, or sewage disposal contrary to Policy H7(4)(e).
- The development is not compatible with the physical and visual landscape of the area contrary to policy H7(4)(f).
- The Leicester City and Leicestershire Gypsy, Traveller and Travelling Show people Accommodation Assessment May 2017 identified a need to provide 1 pitch in the years 2021-2026 and a total of 7 to 2036. The development significantly exceeds this need estimate.
